Terms and Conditions

 

This Agreement, together with all attachments incorporated herein specifically by reference, represents the entire understanding of the Parties with respect to the subject matter hereof and all other agreements, whether written or oral, between the Parties relating to the Service shall be superseded by this Agreement. In entering into this Agreement, neither Party is relying upon any representation of warranties that are not set forth in this Agreement.

iGreyConnect reserves the right at its absolute discretion to modify, delete, or add to any of the terms and conditions of this Agreement without the need of giving prior notice in writing to the Subscriber.

 

Contract Period

This Agreement shall take effect upon installation and activation of the service.

The contract period should last until the Subscribers’ termination of the service.

In the event that the subscriber wishes to discontinue the service and terminate the contract, the subscriber should advise iGreyConnect before the new billing date or before the end of the month. Failing to do so will result in an automatic billing for the following month and shall be settled to successfully terminate the service and/or contract

 

Installation

Installation and activation shall be mutually agreed upon with the subscriber based on the proposed date and time once it is ready for service. An Installation fee should be settled on the day of installation (if any). The rights and privileges extended to the Subscriber in relation to the subscription including the ONU (Optical Network Unit) and its Peripherals are purely personal to the Subscriber and shall not be transferred to any individual or entity or to any other location, without obtaining the prior written consent, approval and clearance from iGreyConnect.

This equipment and peripherals shall at all times remain the property of iGreyConnect.

 

Billing and Payment

iGreyConnect shall bill the Subscriber the Fixed Monthly Service Fee of the Subscriber’s chosen service plan. If applicable, a staggered installation fee shall be charged on top of the monthly service fee starting on the first month of the service. These fees and/or charges must be paid in full by the Subscriber on or before the Due Date indicated in the Billing Notice as sent to the Subscriber’s email address and billing address. Billing notices will be sent through email, SMS, and billing address. Should the Subscriber fail to receive the Billing Notice for whatever reason the Subscriber agrees to inform, by any means, iGreyConnect. Otherwise, it shall be conclusively presumed that the Subscriber has received the Billing Notice in due course. Subscriber acknowledges that iGreyConnect may suspend the Service in case of Subscriber’s failure to pay any bill on or before the specified Due Date.

 

Changes on Current Subscription

The Subscriber shall contact iGreyConnect during the office hours for plan upgrade/downgrade request. The upgrade request will be catered to within 24 working hours. Request for Plan downgrade shall be filed at least 1 day before the end of the billing period, subject to applicable charges (if any). The effectiveness of the request will take place every End of the Month of Billing (cut-off 30th) or next month's billing.

Example:

The downgrade request date is June 15, the downgrade will take effect on July 1.

The downgrade request date is June 30, the downgrade will take effect on July 1.

 

Service Repair and Maintenance

Subscriber shall be entitled to free spare parts and services for non-performance of the ONU and/or peripherals due to factory defects for the term of this Agreement. However, the cost of repair and maintenance of ONU and/or peripherals as a result of damage due to the fault or negligence of Subscriber or due to force majeure shall be for the account of Subscriber and shall be billed in Subscriber’s next Billing Notice.

 

Service Level Agreement

Any issues that occur shall be reported immediately through SMS or call or through our official Facebook page. iGreyConnect shall respond via text or call within 12 hours from the time it was reported. In the event that the issue needs site visitation, iGreyConnect will respond within 36 hours. iGreyConnect provides 80% minimum guaranteed speed at 90% service reliability.

In case of an outage due to maintenance and network issues (excluding acts of nature affecting all the subscribers) that may last for more than 24 hours, iGreyConnect shall provide a timely update to all the subscribers and will deduct a per day cost on the Subscriber’s monthly service fee.

 

Limitation of Liability

iGreyConnect holds no liability for any loss or damage due to any failure of service caused by malfunction of ONU or its peripherals for whatsoever reason.

iGreyConnect will not be liable for any indirect, incidental, consequential, punitive, special, or other similar damages, and out-of-pocket expenses, including but not limited to damages resulting from loss of actual or anticipated revenues or profits, or loss of business, data, or goodwill.

 

Disconnection

Subscriber agrees that iGreyConnect may, without prior notice, disconnect the service of any Subscriber if the bill remains unpaid on the due date as indicated in the billing notice.

Subscriber also agrees that iGreyConnect may temporarily suspend the Service in any of the following instances:

Violation of any of the terms and conditions;

Illegal transfer or relocation of connection;

Failure to notify new billing address;

Illegal connection or use of unauthorized equipment/accessories; or

Other similar causes that stated above.

 

Reconnection

In the event of suspension or disconnection, iGreyConnect may (at its option) restore service and/or rectify the cause of suspension upon payment of all outstanding obligations by the Subscriber, including any and all applicable fees.

 

Termination of Service

iGreyConnect may terminate the service or this Agreement for non-payment or delay in payment of subscriber’s accountabilities, or for violation by Subscriber of any provision of this Agreement, or for such other causes set forth in this Agreement. Subscriber hereby authorizes iGreyConnect representatives to enter the Subscriber’s premises where the ONU and/or Peripherals are installed and allow iGreyConnect to pull out or remove such ONU and/or Peripherals.
